If the company is in the red zone, the exit of the worker may be inevitable?

 Immigration laws in Saudi Arabia are clear. Juzaat is the institution responsible for foreigners' residence card 'Iqama' and exit re-entry 'Izhur wawadah' or final exit known as 'Izhur Nahai' in Arabic.

  According to the Juzaat Law, there is no fee for final exit, whereas there is a fee for exit re-entry, which is charged on a monthly basis.

Answering the question, Juzaat said that in case of any dispute between the employer and the employee, the Department of Manpower and Social Welfare of the Ministry of Manpower and Social Welfare should register the details of their case and apply for a better decision after considering the matter. 

It should be noted that a special department has been established in the Saudi Ministry of Manpower and Social Welfare to resolve any kind of differences between workers and sponsors, where legal problems faced by workers are found.

According to the law, workers against whom illegal habeas corpus is filed are offered legal dispute resolution in the special department of the Ministry of Manpower.

Before approaching the ministry department the worker should provide documentary evidence to strengthen his case to facilitate decision making.

According to the law, it is the responsibility of the sponsor to issue the iqama of the new worker. The probationary period of a new worker in the Kingdom is 3 months.

Before the expiry of the period, it is the employer's responsibility to either issue the worker's residence permit or extend it by mutual consent to the probationary period.

A fine of 500 Rials will be imposed in case of not issuing Iqama before the end of the trial period. The worker has to produce proof that he did not abscond from the employer but remained in contact with him.

Answering the question, Juzaat said that "Foreigners against whom no violation has been recorded and there is no challan payment pending, they can get withdrawal from their sponsor's Abshar or Muqim account." .

In case any kind of violation against the worker is recorded in the central computer of authorizations, their exit cannot be stopped until it is eliminated. The file must be completely clean of violations in order to be cleared.
